Terms of Service

1. Agreement to Terms

By accessing or using PreachCaster ("Service"), operated by SOMA Insights through Nomion AI ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

PreachCaster is an automated platform that transforms YouTube sermon uploads into podcast episodes distributed across major platforms (Apple Podcasts, Spotify, Amazon Music, and others). The Service includes AI-powered features such as sermon transcription, semantic search, summaries, discussion guides, and scripture extraction.

3. Eligibility

You must be at least 18 years old and authorized to act on behalf of your church or organization. By registering, you represent that you have the authority to bind your organization to these Terms.

4. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@nomion.ai if you suspect unauthorized access.

5. Free Trial

We offer a 14-day free trial for all subscription tiers. No credit card is required to start. During the trial, processing is limited to the 5 most recent sermons from your YouTube channel. Full back catalog processing is available after subscribing to a paid plan.

6. Subscriptions & Billing

After your trial, continued use requires a paid subscription. PreachCaster offers three tiers: Core, Pro, and Premium, each billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis.

• Subscriptions renew automatically unless cancelled before the next billing cycle.
• You may cancel at any time; access continues through the end of the current billing period.
• Refunds are not provided for partial billing periods.
• We reserve the right to adjust pricing with 30 days' prior notice.

7. YouTube Content & Authorization

By connecting your YouTube channel, you represent that you own or have the right to use the sermon content on that channel. You grant PreachCaster a non-exclusive license to access, download, process, and redistribute your YouTube content as podcast episodes and AI-generated materials for the duration of your subscription.

8. AI-Generated Content Disclaimer

PreachCaster uses artificial intelligence to generate sermon summaries, discussion guides, scripture references, and other content features. You acknowledge that:

• AI-generated content may contain inaccuracies, misinterpretations, or errors.
• AI output should be reviewed by qualified staff before use in ministry settings.
• Scripture references may be imprecise and should be verified against authoritative texts.
• We do not guarantee theological accuracy and are not responsible for how AI-generated content is used.
• AI-generated discussion guides and summaries are supplementary tools and not a substitute for pastoral teaching or study.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload content you do not have the right to distribute.
• Attempt to reverse-engineer, disassemble, or interfere with the Service.
• Use automated tools to scrape, copy, or harvest data from the Service.
• Redistribute AI-generated content as standalone commercial products.
• Share account credentials or API keys with unauthorized parties.

10. Intellectual Property

You retain ownership of your original sermon content. PreachCaster retains ownership of the Service, its software, branding, and any proprietary methods used in processing. AI-generated outputs (summaries, guides, tags) are provided for your use under your subscription but may not be resold or sublicensed independently.

11. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We process your data in accordance with applicable laws and use industry-standard encryption to protect sensitive information.

12. Limitation of Liability

To the maximum extent permitted by law, PreachCaster and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

13. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

14. Termination

Either party may terminate the agreement at any time. Upon termination:

• Your access to the dashboard and AI features will be revoked.
• Your podcast RSS feed will continue to serve existing episodes for 30 days.
• Audio files hosted on our infrastructure will be retained for 90 days, then deleted.
• We reserve the right to suspend accounts that violate these Terms without notice.

15. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of California. You agree to waive any right to a jury trial or participation in a class action.

16. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice within the Service. Continued use after changes constitutes acceptance of the revised Terms.
